DIVORCE, DIVISION OF PROPERTY AND SPOUSAL MAINTENANCE (ALIMONY)

We regularly commence and defend divorce actions. Whether contested or un-contested, we have the ability to obtain a divorce in a most time-efficient and cost-effective manner. Our cases often involve business interests, real estate, retirement plans and investments. We have expertise in identifying marital assets, valuing them and negotiating or, where necessary, litigating their division in equitable distribution. In addition, we analyze income, earning capacity and expenses in determining the duration and amount of maintenance appropriate in each case. Oftentimes, we address income imputed to a closely-held business owner in determining the scope of maintenance. Where required, we seek interim relief for clients during the course of a divorce proceeding. This relief, available as an exercise of the court’s broad equitable powers, includes preservation of assets, exclusive use & occupancy of the marital home, pendente-lite maintenance and interim distribution of marital assets.

CHILD SUPPORT

Upon separation, the issue of child support must be addressed. Whether the parties are W-2 wage earners, licensed professionals, or sole proprietors, we are experienced at analyzing financial documents and accurately calculating income for a determination of child support. Whether the support case requires a simple Guidelines calculation or a more detailed analysis, we work with the client to handle either situation. We will insure that the representation to the court will be clear and concise, so that the resulting Order will be appropriate and correct.

CHILD CUSTODY AND VISITATION

One of the most important areas of our practice is determination of the legal and physical custody of minor children. Whether the issue is relocation, primary physical custody, or third-party rights, we counsel our clients on all aspects of physical and legal custody and assist in developing a custodial arrangement that is truly in the best interest of the child. Where there is the desire to negotiate an appropriate schedule, we will actively pursue this course as a first option. If however, litigation is necessary, we will present to the court a well thought out and thoroughly prepared case.

DOMESTIC VIOLENCE
